ARTICLE 1 – PERSONAL INFORMATION COLLECTED

When you make a purchase on Easy Gusto, as part of our buying and selling process, we collect the personal information you provide to us, such as your name, address, email address, or phone number.

When you browse Easy Gusto, we also automatically receive the Internet Protocol address (IP address) of your computer, which allows us to obtain more details about the browser as well as about the operating system you are using.

As part of email marketing, with your permission, we may send you emails about Easy Gusto regarding new products and other updates or about your unfinished orders.

How do we obtain your consent?

When you provide us with your personal information to complete a transaction, verify your credit card, place an order, schedule a delivery, or return a purchase, we assume that you consent to us collecting your information.

ARTICLE 4 – SHOPIFY

Easy Gusto is hosted on Shopify Inc. They provide us with the online commerce platform that allows us to sell you Easy Gusto services and products.

Your data is stored in Shopify's storage system and databases. In the general Shopify application, your data is kept on a secure server protected by a firewall.


For payment, if you make your purchase through a direct payment gateway, Shopify will store your credit card information. This information is encrypted in accordance with the data security standard established by the payment card industry (PCI-DSS). The information related to your purchase transaction is retained for as long as necessary to complete your order. Once your order is completed, the information related to the purchase transaction is deleted. Therefore, we do not have direct access to the information you used to place your order. This information is transmitted via Shopify and payment processors.

Indeed, all direct payment gateways comply with the PCI-DSS standard. This security standard of the payment card industry, PCI-DSS in English for Payment Card Industry Data Security Standard, is established by the five major card networks (Visa, MasterCard, American Express, Discover Card, and JCB). These standards ensure the secure processing of credit card data during your purchases on Easy Gusto and by its service providers.

ARTICLE 5 – SERVICES PROVIDED BY THIRD PARTIES


Generally, the services provided by third-party vendors that we use will only collect, use, and disclose your information to the extent necessary to perform the services they provide to us, such as payment processing.

However, some of these providers, such as payment gateways and other payment transaction processors, have their own privacy policies regarding the information we are required to provide them for your purchase transactions on Easy Gusto.

Regarding these third-party providers, we recommend that you carefully read their privacy policies so that you can understand how they will handle your personal information. It should not be forgotten that some of these third-party providers may be located or have facilities located in a jurisdiction different from yours or ours. For example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, the information belonging to you that was used to complete the transaction may be disclosed under United States legislation, such as the Patriot Act.

Once you leave the Easy Gusto site or are redirected to the website or application of a third party for your payment, you are no longer governed by this Privacy Policy or the General Terms and Conditions of Sale and Use of Easy Gusto.

ARTICLE 6 – SECURITY

To protect your personal data, reasonable precautions are taken by us and we follow industry best practices to ensure that they are not lost, diverted, accessed, disclosed, altered, or destroyed improperly.

In the event that you provide us with your credit card information, it will be encrypted using SSL security protocol and stored with AES-256 encryption. This means that no human being will have access to the full card number. Although no method of transmission over the Internet or electronic storage is 100% secure, we comply with all PCI-DSS standards and implement additional standards generally recognized by the industry.

COOKIE FILES

Below you will find a list of cookies that we use. We have listed them below so that you have the option to choose whether or not you wish to allow them.

_session_id is a unique session identifier that allows Shopify to store information related to your session (referrer, landing page, etc.).

_shopify_visit saves cookies for 30 minutes since the last visit. Beyond that, no data is recorded. This cookie is used by the internal statistics tracking system of the provider Easy Gusto to record the number of visits.

_shopify_uniq, this cookie expires at midnight the next day based on the visitor's location. This cookie calculates the number of visits to a store by a unique customer.

cart, this unique identifier persists for 2 weeks and stores information related to your shopping cart.

_secure_session_id is a unique session identifier.

storefront_digest is also a unique identifier. It is undefined if the store has a password. It is used to determine if the current visitor has access or not.


ARTICLE 7 - AGE OF CONSENT

By using Easy Gusto, you declare that you are at least of the age of majority in your country, state, or province of residence, and that you have given us your consent to allow any minor under your care to use Easy Gusto.


ARTICLE 8 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please check it regularly. Changes and clarifications will take effect immediately upon their publication on the website. If we make changes to the content of this policy, we will notify you here that it has been updated, so you can know what information we collect, how we use it, and under what circumstances we disclose it, if applicable.

If Easy Gusto is subject to an acquisition by or a merger with another company, your information may be transferred to the new owners so that we can continue to sell you products.

ARTICLE 9 - SMS MARKETING

By entering your phone number at checkout and initiating a purchase as well as subscribing via our marketing signup list, you agree that we may send you SMS notifications (for your order including abandoned cart reminders) or SMS marketing offers.

The number of marketing text messages will not exceed 30 per month. You can unsubscribe from any further text messages by responding with the word STOP. Sending text messages or using automations requires you to transmit the phone numbers or names of the recipients. This data will be Stored and used to communicate the analysis and results of the campaign, including the status of message delivery, the sending status, and, in some cases, whether the purchase resulted in a sale to Easy Gusto.

If you decide to use our link shortener in text messages, we will collect this information to know whether the link was clicked or not and will use it to display results in the analytics. Any other third-party service you may decide to use outside the scope of smsbump.com, our text messaging operator, the system we use to send SMS (third-party link shortener, GA tracking, etc.) will refer you to their specific third-party policies that you must accept.

When sending text messages, we will transmit the data to our text messaging operator to carry out the sending of messages. The information is shared with our operator only at the time of initializing a marketing campaign and sending messages. If recipients no longer wish to receive messages, they must reply to the message with STOP or contact us at the email address EasyGusto@orange.fr so that we can successfully unsubscribe you.
